Terms of use
These terms apply to everyone who uses Pikobello AI: brands, creators and agencies. They are kept short and written in plain language. What you read here is what the platform really does.
This is a translation. The original terms are written in Dutch, at pikobello.ai/terms. If the two versions differ, the Dutch version prevails.
Operator of the platform
Pikobello AI is operated by:
Boostique BV, trading as VibeLab
Ter Platen 25B, 9000 Ghent, Belgium
Company number and VAT number BE 1025.380.763
Questions about these terms go to hendrik@vibelab.be. A person reads and answers that address.
1 What Pikobello does
Pikobello is a platform where brands publish content assignments and creators apply for them, deliver their work, publish it and report how it performed. Agencies can act in this for a brand, for a creator, or for both. Brands and agencies can also search for Belgian creators there through Discover, which runs on SocialScout, another service of the operator.
We are no party to the agreement between a brand and a creator. What exactly gets made, what it costs, when and how it is paid and which rights to the content transfer are agreed between brand and creator. We facilitate the conversation and keep track of what happened. Payments do not run through the platform today.
2 Account and access
- You must be at least 18 years old to use an account. When you create an account, you confirm that you are 18 or older and that you agree to these terms and the privacy policy. If we learn that you are under 18, we close your account.
- You provide correct details and keep them up to date. Follower counts and engagement rates you enter must be correct at the moment you enter them.
- Your account is personal. Do not share your login details. If you suspect someone else can get in, change your password and let us know.
- Anyone using an account on behalf of a brand or agency declares they are authorised to do so.
- You create an account yourself at app.pikobello.ai, or as a creator through WhatsApp. You can also accept an invitation from a brand or agency.
3 Rules for creators
- You deliver work you made yourself, or for which you arranged all the necessary rights, including those of everyone who appears in it.
- You follow the rules of the platform you publish on and the advertising law that applies to you. You disclose paid collaborations as required.
- The figures you report come from your own statistics and are correct to the best of your knowledge. If you see a flag on what you passed on, correct it right away in the same conversation. Knowingly passing on invented figures is a reason to end your access.
- You only mark a deliverable as published when the post is really there, with the correct link and publication date.
- You are responsible for your own taxes and social contributions on what you earn.
4 Rules for brands and agencies
- A campaign contains an honest brief: what you expect, what budget comes with it and when it has to be done.
- You review deliverables within a reasonable time. If you ask for changes or reject, you give a reason. The platform also enforces this technically: a rejection without a reason is refused.
- You pay what you agreed with the creator, according to the agreement you made with them.
- You use data you see on the platform only for the collaboration you received it for. Selling it on or passing it to third parties is not allowed.
- You approach creators you find through Discover only for a collaboration. Pikobello emails such a creator once in your name. A second email is only possible after she replied, and you do not get to see her email address.
- You use the flags on reported figures as a reason for a conversation. They do not establish fraud. See chapter 8.
5 Importing creator lists
The platform lets brands and agencies enter lists of creators. Whoever does so takes on the following obligations:
- You only enter data you obtained lawfully and that relates to the professional activity of the person concerned.
- For those records, you are the controller within the meaning of the GDPR. Pikobello acts as processor. You decide what you use that list for, and you remain responsible for informing the people on it.
- The people entered get no automatic message from us. Inviting them is a separate action you take deliberately.
- If you invite someone from your list, or open a campaign to your own list, Pikobello sends an email in your name with an unsubscribe link. Anyone who unsubscribes gets no more emails from Pikobello, also not on your behalf.
- We never use the contacts you entered for another brand's campaign.
- If someone objects or asks for deletion, we cooperate and expect the same from you. We may delete such a record at the request of the person concerned, also without your agreement.
How this works out for the person entered is described in chapter 3 of the privacy policy.
6 Agencies that work for two parties
On this platform, an agency may act for a brand and represent creators at the same time, also when one of those creators applies to a campaign of that brand. In that case the agency may review that application itself. Nothing technically blocks this.
In return:
- The overlap is shown to all three parties, including the creator, and is computed at that moment.
- A represented creator can ask for their agency's active client list before applying anywhere.
- An agency acts within the permissions the brand gave, and within the permissions the creator gave. Every action in the name of a brand is logged, with the time and the person who took it.
- A brand or a creator can withdraw the tie with an agency at any time. Access ends at the next request.
An agency that actively hides a conflict from either party breaches these terms.
7 Connector keys, AI assistants and WhatsApp
- A connector key connects your AI assistant to the platform. Whoever has the key acts as you. Do not share it, and revoke it as soon as you have doubts.
- We do not store the key in readable form and cannot show it again. Lost means creating a new one.
- You can connect ChatGPT or Claude to one workspace you have access to. The assistant acts there as you, with your access, and what you have it do falls under your responsibility, just like what you do yourself in the dashboard. If in doubt, revoke the connection under Connected apps in Pikobello.
- An AI assistant can make mistakes. Look at the preview it shows before you confirm a change, especially when the change reaches a creator, such as a message, an invitation or a decision on an application or deliverable.
- Your use of ChatGPT or Claude is also covered by the terms of OpenAI or Anthropic. What the assistant reads in your workspace goes to that provider under your own account. See section 2.10 of the privacy policy.
- Brands and agencies may use their own assistant as a tool for the collaboration. What that assistant reads about creators falls under the same rule as in chapter 4: you use it only for that collaboration. You arrange the agreements with the provider of your assistant yourself.
- Use of the WhatsApp channel is also covered by WhatsApp's own terms. Do not send content that does not belong there.
- Automated traffic that puts load on the platform or that collects data outside your own collaborations is not allowed.
8 What we do and do not claim about the figures
Performance figures on this platform come from screenshots creators send themselves, or a brand or agency enters them itself. A language model reads a screenshot and passes the numbers on. We have no connection with Instagram, TikTok or YouTube and therefore do not check the figures at the source.
The database does one thing: it checks whether the numbers are plausible relative to each other and adds a flag when they are not. Such a flag means the figures conflict with each other. In practice, that is usually a reading error by the model. It does not establish fraud, and it may not be used as if it did. Equally, the absence of a flag is no proof that the figures are correct.
Brands that need certainty about performance ask the creator to look at the statistics together, or agree on a check of their own.
9 Content and intellectual property
- The content a creator makes stays the creator's. Which usage rights a brand gets is agreed between brand and creator. The platform grants itself no rights to that content.
- Brand material a brand supplies stays that brand's. A creator only uses it within the assignment.
- The name Pikobello, the logo, the software and the design of the platform remain the operator's.
10 Illegal content and reports
On Pikobello, users post content themselves: campaigns and briefs, profiles, applications, messages, feedback on deliverables and files someone uploads through a request. We do not check that content in advance. We act when someone reports something to us, or when we notice something ourselves. A person assesses every report; we use no automated systems for that. What follows is how we work under the Digital Services Act (Regulation (EU) 2022/2065).
One point of contact. Reports and questions from users go to hendrik@vibelab.be. That address is also the point of contact for the authorities of the member states, the European Commission and the European Board for Digital Services. You can write to us in Dutch or English. In the app, the Report content link opens an email to that address. Addresses on pikobello.ai receive no email.
What a report must contain.
- where the content is: the link, or the name of the campaign, the profile or the conversation, as precisely as you can;
- why you think it is illegal, with enough explanation to assess that;
- your name and your email address. If the report concerns sexual abuse or sexual exploitation of children, you do not have to give them;
- a statement that you report in good faith, and that what you write is accurate and complete to the best of your knowledge.
Content that breaks these terms can be reported the same way. If it concerns a post on Instagram, TikTok or YouTube, report it to that platform: we only keep the link to it.
How we decide. You get a confirmation that your report arrived. We look at the content and decide carefully, objectively and without undue delay. We can remove the content or make it invisible, restrict a feature, or suspend or close an account. If the report does not hold, we leave the content up.
We tell both sides what we decided and why: the person who reported, and the person who posted the content. That email says which content it concerns, what we did, which law or which provision of these terms we rely on, and how to appeal. We only skip this when the law or an authority forbids it, or when we have no contact details.
If something points to a criminal offence that threatens someone's life or safety, we report it to the police or the public prosecutor straight away.
Appealing. If you disagree with our decision, reply to the email in which we told you. You can do that up to six months after the decision, free of charge. We review your objection and send you a reasoned answer. You can also turn to a certified out-of-court dispute settlement body as referred to in Article 21 of the Digital Services Act, or go to court.
Repeated breaches. Anyone who repeatedly posts clearly illegal content first gets a warning. If it happens again after that, we close the account. If someone repeatedly sends clearly unfounded reports, we stop handling their reports for a while. We look at how often it happened, how serious it was and whether it seemed intentional.
11 Costs
Today the platform charges nothing and no payment runs through the platform. If that changes, we tell you in advance and it only applies after you agree. Fees between brand and creator are arranged between them.
12 Availability
Pikobello is still being built. We promise no uninterrupted availability, no fixed response times and no guarantee of storage. Parts can change or disappear. If it concerns something you actively work with, we warn you in advance.
You remain responsible for keeping your own copy of what you need, such as your content files and your agreements with the other party.
13 Liability
We do our best to make the platform work correctly and to protect the data in it. We are not liable for the behaviour of other users, for agreements between brand and creator that are not kept, for unpaid fees, or for a campaign that does not deliver results.
Our liability is limited to what the law mandatorily prescribes, and to direct damage caused by a fault of ours. Liability for fraud and for intent is never excluded. If you are a consumer, these terms do not affect your mandatory statutory rights.
14 Stopping and exclusion
You can stop at any time. Ask for deletion of your account through the page on having your data deleted (in Dutch).
We can suspend or end an account for a serious or repeated breach of these terms, for example for invented performance figures, for content whose rights were not arranged, or for misuse of other people's data. We tell you why, and you get the chance to respond, unless the law does not allow that. For illegal content, the procedure in chapter 10 applies as well.
15 Changes
We can change these terms when the platform changes. The date and the version at the top say when they were last updated, and we record with your account which version you accepted. For a meaningful change, we inform users with an account directly. If you do not agree, you can stop and have your data deleted.
16 Applicable law
These terms are governed by Belgian law. Disputes are brought before the courts of Ghent, unless consumer law gives you as a consumer another court, such as that of your place of residence.
If a provision of these terms turns out to be invalid, the other provisions still apply.
